More recently, Smith slimmed down and became the spokesperson for the weight loss product from Russel Simmons.

Her highly publicized marriage to entrepreneur J. Howard Marshall, 63 years her senior, resulted in a lengthy and ongoing legal battle over his estate following his death. Her case, Marshall v. Marshall, reached the U.S. Supreme Court in February, 2006, on a narrow constitutional issue over the right of a federal judge to intervene in a state probate case. On May 1, 2006, Smith won the Supreme Court case 9-0.

Biography

Early life

Anna Nicole Smith was born in Houston, Texas as Vickie Lynn Hogan. When she was very young, her family moved to Mexia, a small town 79 miles (127 km) south of Dallas. Her father left the family when Smith was a child and she was raised by her mother and aunt. Anna has a half-sister Donna Hogan. While growing up, Smith told others that she wanted to be the next Marilyn Monroe. Smith worked at Jim's Krispy Chicken restaurant in Mexia in her teens. On April 4, 1985, at age 17, she married Billy Smith, a cook at the restaurant, who was 16. The next year, she gave birth to her first child, the late Daniel Wayne Smith, and the following year she and Billy divorced.

In her early 20s, Smith worked at a variety of low-paying jobs while supporting her son Daniel. While working as an exotic dancer at a nightclub in Houston under various names including Nikki, Robin and Anna Nicole, she met oil billionaire J. Howard Marshall, a frequent customer of the strip club. With Marshall’s money, Smith had cosmetic surgery to increase her breast size, paid for photographers, publicists, wardrobe, living expenses, hair and make-up stylists, bodyguards, talent agents, attorneys and a host of other support staff.

Playboy and modeling career

Smith's career took off after appearing on the cover of the March 1992 issue Playboy magazine wearing a low-cut evening gown. She secured a contract to replace supermodel Claudia Schiffer in the Guess? jeans ad campaign in a series of sultry black and white photographs. Guess? capitalized on Anna Nicole's strong resemblance to sex symbol Jayne Mansfield and even put her in Jayne inspired photo sessions. Smith then posed nude for Playboy as the May 1992 centerfold (under her given name). Smith was subsequently called "the next Marilyn Monroe" in press reports, a comparison she encouraged by wearing a hair style reminiscent of Monroe's, as well as her trademark white dress. Smith was chosen to be the 1993 Playmate of the Year. She finally settled on the name "Anna Nicole Smith" by the time of her PMOY pictorial. Smith once did a nude Playboy lay out in Jayne Mansfield's famous "Pink Palace" mansion.

Marriage to Marshall

Smith married her second husband, oil billionaire J. Howard Marshall on June 27, 1994. She was 26; he was 89. According to an E! profile, Smith had other relationships and was generally indifferent to Marshall, with whom she never lived. Her alleged romantic interests included bodybuilder Clay Spires, Scott Baio, John Travolta's nephew Rikki, and real estate mogul Jonathan McManus. J. Howard's nurse told E! that Smith never visited him as his condition became terminal, and was not with him when he died.

Within weeks after J. Howard's death on August 4, 1995, Smith squared off against his son, E. Pierce Marshall, for half of her late husband's $1.6 billion estate. Smith joined forces with J. Howard's other son, James Howard Marshall III, whom the elder Howard had disowned. Howard III claimed J. Howard verbally promised him a portion of his estate; like Smith, Howard III was also left out of J. Howard's will, which he updated weeks after their marriage.[1] The case has gone on for more than a decade, producing a highly publicized court battle in Texas and several judicial decisions that have gone both for and against Smith in that time.

Smith claimed J. Howard verbally promised her half of his estate if she married him. In September, 2000, a Los Angeles bankruptcy judge awarded Smith $449,754,134. Pierce appealed, and in July 2001, Houston judge Mike Wood vacated that award and ordered Smith to pay over $1 million in fees and expenses to Pierce's legal team. In March 2002, she was awarded $88 million. In December 2004, a three-judge panel of the U.S. 9th Circuit Court of Appeals reversed the March 2002 decision, saying that Smith is not one of J. Howard Marshall's heirs.[2] The U.S. Supreme Court decided in September of 2005 to hear the appeal of that decision. The Bush Administration subsequently directed the Solicitor General to intercede on Smith's behalf out of an interest to protect federal court jurisdiction in state probate disputes.[3]

After months of waiting, Smith and her step-son Pierce learned of the Supreme Court's decision on May 1, 2006. The justices unanimously decided in favor of Smith. Justice Ruth Bader Ginsburg wrote the majority opinion, stating that Smith should get a chance to pursue her claims in federal court. (See Marshall v. Marshall.)

This decision does not give Smith a portion of her husband's estate; it merely reaffirms that she has the right to fight for it in federal court. It is expected that the long-running legal drama will not end any time soon, because many remaining issues need to be decided upon remand. On June 20, 2006, E. Pierce Marshall died at the age of 67 after an infection.

As reported by Court TV and in the article "Family Vows To Battle Anna Nicole Smith," published in USA Today on July 24, 2006, E. Pierce Marshall's widow, Elaine Tettemer Marshall (born January 12, 1939), now represents her late husband's estate, which continues to oppose Anna Nicole Smith in the case Marshall v. Marshall.[4]

During the course of the litigation, Smith's career stalled. Though her roles in The Hudsucker Proxy and Naked Gun 33 1/3: The Final Insult, both in 1994, were highly publicized, her acting career did not take off. She was instead relegated to low-budget movies such as Skyscraper and became regular fodder for the tabloids due to her legal battle over her nonagenarian husband's estate, her increasing weight, and her reportedly bizarre behavior. In 2002, she was given her own reality TV series on the E! cable television network; The Anna Nicole Show which focused on her personal and private life in the manner of other "reality" shows, such as ratings hit The Osbournes. The show's debut was the highest rated show on the network, but critics blasted the show and ratings dropped with each successive week. However, the show achieved a kind of camp or cult status as many fans found humor in Smith's absurd antics. The show was cancelled in February 2004, due to "creative differences," but has retained some life in reruns and on DVD releases.

Smith as spokesperson

In an interview on Late Night with Conan O'Brien she was asked what her "Playmate diet" consisted of. She instantly replied, "fried chicken." In October, 2003, she became a spokesperson for TrimSpa, which helped her to lose a reported 69 lb (31 kg).

In November 2004, she appeared as a presenter at the American Music Awards and attracted attention because of her strange behavior. During her live appearance, she made cryptic, murmured comments about her body and TrimSpa. This incident became comic material for the rest of the presenters and featured in the news the next day. Tabloids speculated that she was under the influence of pills or some other controlled substance. Her representatives explained that she was in pain due to a series of grueling work-outs, and asserted that she had difficulty reading the prompter because she was not wearing her contact lenses. After reportedly losing some 80 pounds, Smith returned to her form from the early 1990s.[5]

In March 2005, at the first MTV Australia Video Music Awards in Sydney's Luna Park, she spoofed Janet Jackson's wardrobe malfunction by pulling down her dress to reveal both breasts, each covered with the MTV logo.

She has also been featured in advertisements for the animal rights group PETA. Spoofing Marilyn Monroe's "Diamonds Are a Girl's Best Friend" segment in Gentlemen Prefer Blondes, a 2004 ad states "Fur-free blondes are best." In another ad the following year, Smith posed with her dogs in a campaign against Iams dogfood for their alleged cruelty to animals. As of 2006, Smith has given up modeling, though she remains a spokesperson for TrimSpa.

Birth of her daughter and death of her son

On June 1, 2006, Smith announced on her official website that she was 5 months pregnant. Although she will not publicly name the father, it is rumored to be photojournalist Larry Birkhead.[6] On September 7, 2006, Smith gave birth to a baby girl, Hannah, at Doctors Hospital in Nassau, Bahamas. Three days later, on September 10, Smith's 20-year-old son, Daniel Wayne Smith, died suddenly while visiting his mother in her hospital room.[7][8] Although the cause of death has not yet been officially determined, officials have ruled out a heart attack or other "natural causes". A coroner's inquest was ordered when it has been revealed that a "third person", later identified as Smith's attorney, Howard K. Stern, was present in the hospital room with Anna and her son just prior to the time of his death.[9]

The autopsy performed by Smith family coroner Dr. Cyril Wecht on September 16, 2006 found evidence of antidepressant medication, but ruled out several natural causes, including heart disease, stroke, or congenital defects.[10] Foul play and "suicidal overdose" were also ruled out by both Dr. Wecht and Bahamian coroner Linda Virgill.[11] Swedish papers reported that Anna Nicole Smith has been granted permanent residency in the Bahamas by Prime Minister Perry Christie, although she plans to bury her son in the U.S.[12] The autopsy and toxicology reports will not be made public until the inquest is held, to avoid prejudicing the jury.[13]

Death

On February 8, 2007, Smith was found unresponsive in a room at the Seminole Hard Rock Hotel and Casino in Hollywood, Florida. It was reported by NewsMax.com that a spokeswoman from her hotel said, "She checked in Monday at 8 p.m. as a guest. She was due to check out tomorrow". [36] At 1:38 p.m. (18:38 UTC) Seminole Police Chief Charlie Tiger said a nurse in Smith's sixth floor room called the hotel front desk, who in turn called security, who in turn called 911. At 1:45 p.m. a bodyguard administered CPR before she was rushed to Memorial Regional Hospital at 2:10 p.m and pronounced DOA at 2:49 p.m. Smith's companion, Howard K. Stern, was with her when she died and has reported to Entertainment Tonight that her temperature was running 104 degrees the night before.[37][38][39][40] An autopsy is expected to be performed on Friday to determine an official cause of death[41], but sources claim she may have choked on her own vomit.[42] Sources have claimed that police have recovered a "large number of prescription drugs".[43]

Reaction

Smith's sister, Donna Hogan, released a statement to the media a short while after her sister's death was announced:

On behalf of the Hogan Family, we are saddened and heartbroken by my sister's death. No matter what our differences have been over the years, Anna was still our blood and she will be missed terribly. She was a woman who was determined to get out of her small town in Texas and make a name for herself. She became an international star and she was a good mother to Daniel; there is no doubt that her son loved her. They lived out of each other's pockets while he was alive and now they can finally be together again in Heaven.

We feel that the death of her son left her deeply saddened, a sadness she hid from everyone. As a mother of three children, I am anguished by this tragic event and the fact that her new baby daughter Dannielynn Hope is now without a mother.

I'm very saddened to learn about Anna Nicole's passing. She was a dear friend who meant a great deal to the Playboy family and to me personally. My thoughts and prayers are with her friends and loved ones during this difficult time.

Cintra Wilson wrote in Salon magazine that: "When she was able to suppress her demons enough to pull herself together and look her best, she was fabulously gorgeous. ... Anna Nicole was a star because she possessed an unusually large amount of beauty. At her best, she didn't evoke Marilyn Monroe so much as Anita Ekberg in "La Dolce Vita" -- the strapless black dress, mounds of white flesh, piles of blond hair. She was indelicate, but an unstable element nonetheless -- not so much a candle in the wind as a bonfire in a hailstorm. But the real similarity between Anna Nicole and Marilyn was their shimmering tension -- an unsettlingly powerful physical beauty, collapsing irresistibly in real time beneath the frailties of its hostess. She was entropy porn at its finest."[46]

Death and funeral

On February 8, 2007, Smith was found unresponsive in room 607 at the Seminole Hard Rock Hotel and Casino in Hollywood, Florida. According to Seminole Police Chief Charlie Tiger, at 1:38 p.m. (18:38 UTC) Smith's friend and bodyguard, Maurice "Big Moe" Brighthaupt, who was a trained paramedic,[77] called the hotel front desk from her sixth floor room. The front desk in turn called security, who then called 911. At 1:45 p.m. the bodyguard administered CPR before she was rushed to Memorial Regional Hospital at 2:10 p.m and pronounced DOA at 2:49 p.m.

A phone call was released to the public on February 13, 2007 involving Seminole police and the local 911 operators, saying:

We need assistance to Room 607 at the Hard Rock. It's in reference to a white female. She's not breathing and not responsive...actually, it's Anna Nicole Smith.[78][79]

Since her death, various legal battles have ensued, regarding the will, the paternity of her daughter, and her final resting place, resulting in a delay in her burial. Smith was finally buried March 2 at Nassau's Lakeview Memorial Gardens and Mausoleum in a plot adjacent to her son, Daniel. Daniel's father reportedly wants his son exhumed and reburied in his home state of Texas. As of March 21, 2007, court hearings in the Bahamas revealed that a paternity test has been ordered and Larry Birkhead, Howard K. Stern, and Dannielynn have been tested already.

After a seven week investigation led by Broward County Medical Examiner and Forensic Pathologist Dr. Joshua Perper in combination with the Seminole police and several independent forensic pathologists and toxicologists, Dr. Perper announced that Smith died of "combined drug intoxication" with the sleeping medication chloral hydrate as the "major component."[80] No illegal drugs were found in her system. The official report states that her death was not considered to be due to homicide, suicide, or natural causes.[81] The full investigative report has been made public and can be found online.[82] Additionally, an official copy of the autopsy report was publicly released on March 26, 2007 and can be found online.[83]

Ultimately her death was ruled an accidental drug overdose of the sedative chloral hydrate that became increasingly lethal when combined with other prescription drugs in her system, specifically 4 benzodiazepines; Klonopin (Clonazepam), Ativan (Lorazepam), Serax (Oxazepam), and Valium (Diazepam). Furthermore, she had taken Benadryl (Diphenhydramine) and Topamax (Toprimate), an anticonvulsant GABA agonist, which likely contributed to the sedative effect of chloral hydrate and the benzodiazepines.[84] Although the individual levels of any of the benzodiazepines in her system would not have been sufficient to cause death, their combination with a high dose of chloral hydrate led to her death. The autopsy report indicates that chloral hydrate was the "toxic/lethal" drug, but it is difficult to know if chloral hydrate ingestion would have killed her alone, since Dr. Perper indicated (in the March 26 press conference) that she had built up a tolerance to the drug and took more than the average person. He indicated that she took about 3 tablespoons, whereas the normal dosage is between 1 and 2 teaspoons. Despite rumors of methadone use due to its involvement in her son's death, Dr. Perper only found methadone in her bile, indicating that it could only have been ingested 2-3 days prior to her death and was not a contributing factor.[85] The autopsy report indicates that abscesses of buttocks (presumably from prior injections of vitamin B12 (cyanocobalamin) and human growth hormone), and viral enteritis were contributory causes of death. Tests for influenza A and B were negative.[86]

On March 31, 2007, TMZ.com reported that FOX News anchor Greta Van Sustren acquired paperwork from Dr. Joshua Perper's office that indicated 8 of the 11 drugs in Anna Nicole Smith's system, including the chloral hydrate, were prescribed to Howard K. Stern, not Anna Nicole. Additionally, two of the medicines were written for Alex Katz and one was written for Anna Nicole's friend and psychiatrist, Dr. Khristine Eroshevitz. Dr. Perper acknowledged that all 11 prescriptions were written by Dr. Eroshevitz herself.[87]
